These Terms of Service (the "Terms") govern your use of hkkindergarten.com and its related web pages, features, and paid products (the "Platform"). The Platform is operated by Magicpaw Limited ("we", "us", or "our"). Please read these Terms carefully before using the Platform.

1. Acceptance of Terms

By browsing, registering, logging in, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as by our Privacy Policy. If you do not agree to any part of these Terms, please discontinue your use of the Platform.

If you use the Platform on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.

2. Nature of the Platform

The Platform is a kindergarten information reference service that aggregates and presents publicly available information about kindergartens in Hong Kong, including but not limited to school profiles, fees, addresses, maps, admission information, education groups, articles, and community content, to help parents and guardians in their initial research and comparison.

The Platform is not an official channel of any school, educational institution, or government department, and has no affiliation or agency relationship with the Education Bureau (EDB) or any kindergarten.

3. Accounts and Login

  • The Platform uses passwordless login, authenticating your identity via a one-time verification code sent to your mobile number or via your Google account.
  • You must ensure that the login information you provide is true and accurate, and you are responsible for all activity conducted through your account.
  • You must keep your mobile phone, Google account, and verification codes secure, and must not allow others to impersonate you when logging in.
  • We reserve the right to suspend or terminate an account where we reasonably suspect misuse, unauthorised access, or a breach of these Terms.

4. Information Disclaimer

  • The information displayed on the Platform is drawn primarily from public and official sources (including but not limited to publicly available Education Bureau data, official school websites, and public documents), and presented after processing.
  • While we strive to keep the information accurate, we do not guarantee the accuracy, completeness, timeliness, or suitability of any information. Information may contain errors or omissions, or may be out of date.
  • All content on the Platform is provided for general reference only and does not constitute professional advice, educational advice, or admission advice.
  • Before making any decision based on any information on the Platform (including choosing a school, applying, or making payment), you should verify the latest and accurate information directly with the relevant schools and the Education Bureau.
  • We do not guarantee any admission outcome. Whether a place is offered depends on each school's admission criteria, interviews, ballots, or other school-based arrangements, and is entirely independent of the Platform. The Platform does not, and cannot, influence any school's admission decisions.

5. Paid Products

We offer the following paid products through the Platform, with payments processed by the third-party payment provider Stripe:

  • Interview Quiz: a one-time fee of HK$68, which permanently unlocks the relevant quiz content on your account upon payment.
  • School Report: a one-time fee of HK$399, upon which we prepare and deliver a personalised school-selection advisory report based on the information you provide.

Supplementary terms for paid products:

  • All prices are quoted in Hong Kong dollars (HKD) and, unless stated otherwise, are as displayed. Prices may be adjusted from time to time, but completed transactions are not affected by subsequent price changes.
  • We do not store your credit card or other payment card details; all payment processing is carried out by Stripe in accordance with its own terms and privacy policy.
  • The paid products on the Platform (the Interview Quiz and the School Report) are digital knowledge-based services. Once payment is made — the quiz content being unlocked immediately, or the School Report having commenced preparation or delivery — the service is deemed provided and no refunds are available.
  • If, due to a technical fault on our part, you have paid but are unable to access the purchased digital content or service, please contact us using the details in Section 13, and we will reasonably assist you in regaining access to or use of that content.
  • Nothing in these Terms affects any rights you may have under applicable law that are mandatorily conferred on consumers.

6. User Conduct

When using the Platform, you agree that you will not:

  • extract, copy, or harvest data from the Platform in bulk by any automated means (including crawlers, bots, or scrapers) without our prior written consent;
  • reverse-engineer, interfere with, or disrupt the Platform, or attempt to circumvent any security measure or access restriction;
  • upload or transmit any content that is unlawful, defamatory, infringing, obscene, threatening, harassing, or misleading;
  • impersonate any person, misrepresent your identity, or otherwise infringe the rights of others;
  • use the Platform for any unlawful purpose or in any manner that violates applicable laws and regulations.

We reserve the right to remove content and to restrict or terminate your access to the Platform where you breach these Terms.

7. Intellectual Property

  • All content on the Platform, including but not limited to text, articles, compilation, design, logos, images, databases, and software (excluding raw factual data sourced from public or official sources), is owned by Magicpaw Limited and its licensors and is protected by Hong Kong and international intellectual property laws.
  • We grant you a limited, non-exclusive, non-transferable right to access and use the Platform's content solely for your personal, non-commercial use.
  • You may not reproduce, publish, distribute, modify, sell, or commercially exploit any content of the Platform without our prior written consent.

8. User Content Licence

  • Where the Platform offers community, forum, comment, or consultation features, you retain ownership of the content you submit ("User Content").
  • For the User Content you submit, you grant us a non-exclusive, royalty-free, worldwide licence to store, display, reproduce, and publish that content to the extent necessary to operate and promote the Platform.
  • You represent and warrant that you own all rights necessary to submit the User Content and that such content does not infringe any third-party rights or violate any law.
  • We have the right (but not the obligation) to review, remove, or refuse any User Content that we consider to be in breach of these Terms.

9. Third-Party Service Terms

The Platform relies on several third-party services to provide its functionality, including Firebase / Google Cloud (hosting, authentication, database), Stripe (payment processing), and Google (login, analytics), among others.

Your use of the relevant features may also be subject to the respective terms of service and privacy policies of those third parties. We are not responsible for the conduct, availability, or policies of those third-party services.

10. Modification / Termination of Service

  • We may modify, suspend, or terminate all or part of the Platform's functionality at any time without individual prior notice.
  • We may from time to time add, change, or remove features and content (including paid products).
  • We are not liable to you or any third party for any modification, suspension, or termination of the Platform, save that rights arising from completed transactions for paid products are not affected.

11. Limitation of Liability

To the maximum extent permitted by the laws of Hong Kong:

  • The Platform and all its content are provided on an "as is" and "as available" basis, without any express or implied warranty, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • We are not liable for any indirect, incidental, special, consequential, or punitive loss (including but not limited to loss of profit, loss of opportunity, or school-selection or admission outcomes falling short of expectations) arising from your use of or inability to use the Platform, or from your reliance on any information on the Platform.
  • In no event shall our aggregate total liability arising out of these Terms exceed the amount you actually paid to us for the relevant paid product in the twelve (12) months preceding the event giving rise to the claim.
  • Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law (including death or personal injury caused by negligence, or fraud).

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. You agree to submit to the non-exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region in respect of any dispute arising out of these Terms or the Platform.

13. Updates to These Terms and Contact Information

  • We may update these Terms from time to time. The updated version will be published on the Platform, and the "Last updated" date at the top shall prevail. Your continued use of the Platform after an update takes effect constitutes acceptance of the revised Terms.

These Terms constitute the entire agreement between you and Magicpaw Limited regarding your use of the Platform. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
